1. Overview
Welcome to Gotcha, a unique rewards club and treasure hunt experience (the “Rewards Club” and the “Game”). By participating, you (“Member” or “Participant”) agree to be bound by these Terms and Conditions, which constitute a binding legal agreement between you and Bronson Tipuna Enterprises Pty Ltd (“we,” “us,” “our”). Members gain access to exclusive rewards, discounts, and weekly treasure hunts (the “Game”) through our custom-designed application (“App”). Game schedules, membership conditions, and benefits may change at our discretion.
2. Eligibility
Members must be at least 18 years of age to join the Rewards Club.
The Rewards Club is open to residents of Australia. Non-Australian residents may participate, but they are responsible for ensuring compliance with local laws.
Employees, contractors, or agents of Bronson Enterprises Pty Ltd, and their immediate family members, are not eligible to participate in the Rewards Club Game.
3. Membership and Access
Membership grants access to the Rewards Club benefits, including discounts and weekly treasure hunt games, from 6:00 p.m. Friday to 6:00 p.m. Sunday (Queensland time), unless otherwise stated.
Access to the Game is a free bonus included with membership. We are not responsible for personal or technical issues that may prevent participation in the Game.
4. Game Mechanics
The Game provides Members with a weekly treasure hunt as an added benefit. Members solve trivia questions within the App to receive clues, which help them locate virtual money bags.
Upon locating and collecting a money bag, its monetary value will be displayed, adding to the Member’s total balance.
The total value of collected money bags determines the Member’s final payout, which will be issued as described in Section 6.
5. Top 3 Prizes
In addition to individual payouts, the Top 3 Members who collect the most money bags by the end of the Game will receive Top 3 Prizes. Prizes will vary for each Game and be announced before the Game begins.
If two or more Members collect the same number of money bags, prizes will be awarded based on our system time, giving priority to the Member who reaches the tied number first.
Our decision regarding timing and winner determination is final. If a Top 3 Prize requires shipping, it will be fulfilled once a tracking number is provided.
6. Payouts and Prize Distribution
Individual Payouts: Members receive payment based on their total collected money bags. Payouts will be issued within 14 business days following the Game period.
Top 3 Prizes: The Top 3 Members may choose to cash out or receive a designated prize. Once a choice is made, it is final. We are not liable for delays or non-delivery due to incorrect information supplied by the Member.
7. Fair Play and Code of Conduct
Members must follow all rules. Cheating, manipulation, or using automated tools will result in disqualification and forfeiture of rewards.
We monitor for suspicious behavior and may suspend or ban Members from future participation.
8. Technical Issues
Members are responsible for maintaining a stable internet connection and compatible device for App access.
We are not liable for technical issues on the Member’s side. If a system failure affects the Game, we may reschedule or cancel it at our discretion.
9. Refunds
Refunds are available if requested before the start of the Membership period. Once the Game has begun, fees are non-refundable. Refunds will be processed within 14 business days for eligible requests.
10. Privacy Policy
We are committed to protecting your privacy. Any personal information provided will be used per our Privacy Policy, accessible in the App. By participating, you consent to the use of your personal information as outlined.
11. General Agreement
By joining, you acknowledge that you have read, understood, and accepted these Terms and Conditions. This agreement supersedes prior agreements or understandings.
12. Dispute Resolution
In case of any dispute:
Initial Negotiation: The parties will try to resolve the issue through discussions within 30 days of notice.
Mediation: If unresolved, the dispute will go to mediation per the Australian Mediation Association’s rules, with costs shared equally.
Arbitration: If mediation fails, it will be resolved by arbitration under Queensland’s Commercial Arbitration Act. The decision is final.
Waiver of Class Action: By participating, you waive the right to class actions.
13. Copyright and Intellectual Property
All content and materials provided through the Rewards Club (the “Materials”) are the intellectual property of Bronson Tipuna Enterprises Pty Ltd and protected by Australian and international laws.
Members may not copy, modify, distribute, or exploit any part of the Materials without our written consent.
14. Deletion of Account
If a Member decides not to continue with the Rewards Club after the Membership period, we reserve the right to delete their account 5 days after the last Game period ends. This deletion includes personal details and any unclaimed rewards.
15. Changes to Terms and Conditions
We may update these Terms and Conditions at any time. Changes will be communicated to Members before the next Membership period.
16. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia, with exclusive jurisdiction in Queensland courts.
